Legal Writing
The legal professionals at LexOutsource are well trained in the art of persuasive and objective legal writing. They draft high quality legal documents, such as pleadings, motions, factums or written submissions, memoranda of law, and summaries.
We set and maintain high standards, requiring perfection in all our written products. A senior legal professional with practical legal experience always reviews and adds the finishing touches to each document, making sure it is a work of art.
In many cases, our comprehensive legal research will act as a foundation for our legal writing. In such case, our legal research will be followed up with a written product, in which we lay out the corresponding legal arguments coherently, comprehensively and logically. Common examples of this are a memorandum of law, a summary, and a factum or written submissions, which almost always must be preceded by legal research.
However, we can also draft certain legal documents without first conducting legal research. Typical examples falling into this category include the drafting of pleadings, motions and letters of demand, which do not always require preceding legal research.
The following are some of the legal documents we typically draft.
Memorandum of law
The process of drafting a memorandum of law begins with research into binding and persuasive case law, statutory provisions, regulatory issuances from administrative bodies and secondary sources (such as journal articles). We then analyze the facts of the matter in light of the applicable law, as determined during the research process. A memorandum of law will then be drafted, objectively analyzing the specific legal problems raised or answering any questions applicable to the particular situation.
Factums and Written Submissions
The process of preparing a factum (or written submissions) is similar to a memorandum of law, except that these are intended to be persuasive, as the intended audience is a court. The client must provide us with the facts of the matter and any supporting documentation. We will then identify the relevant issues, conduct thorough legal research, and draft a high quality and precise factum (or written submissions). This can be done for both civil and criminal cases. We will deliver the factum (or written submissions) to the client via e-mail which will be ready for review, signature, and submission to the court. If necessary, we will even outline and prepare you for oral argument.
Pleadings
We can draft pleadings for all types of civil proceedings, such as statements of claim, notices of motion, and affidavits. This can be done with or without accompanying legal research, depending on the circumstances. We will deliver the pleading to the client via e-mail which will be ready for review, signature, and submission to the court.
Summaries
A summary is an abridged version of a memorandum of law, in that the written product contains only a summary of the relevant information in a short opinion, ensuring easier and more concise access to the desired information.
